Terms of Service

Effective date: 17 October 2026

These terms govern an Internet Service Provider's (ISP's) access to and use of NamsNet Billing, a network and billing management platform offered under the NamsNet Technologies brand ("NamsNet", "we", or "us"). By creating an ISP workspace, starting a trial, or purchasing a subscription, the person accepting these terms confirms they are authorised to bind that ISP.

1. Platform and ISP-customer relationship

NamsNet provides tools for ISP workspace administration, customer records, invoices, payment reconciliation, Hotspot and PPPoE account management, router integrations, reports, and support. The ISP remains the provider of internet access to its own subscribers. Any agreement about a subscriber's access, price, speed, service limits, support, suspension, or refund is between that ISP and its subscriber; NamsNet is not a party to that agreement.

The ISP is responsible for its network, routers, credentials, customer communications, the accuracy and lawfulness of records it enters, and its own licensing, consumer, tax, and data-protection duties. NamsNet does not guarantee that an ISP's internet service, router, payment provider, or mobile network will be continuously available.

2. Workspace, users, and security

The ISP must provide accurate registration and billing information and ensure that staff access is limited to authorised users with appropriate roles. The ISP is responsible for activity performed through its accounts, must protect passwords and router/payment credentials, and should promptly report suspected unauthorised access through the support channel.

Each ISP workspace is intended to keep its operational records separate from other ISPs. The ISP must not attempt to access another workspace, probe or disrupt the platform, bypass access controls, or use NamsNet to violate another person's rights or applicable law.

3. Trial, subscription, and payment

Where offered, a free trial lasts 72 hours from activation and is limited to one trial per ISP. The features, limits, subscription price, billing period, and expiry applicable to a paid plan are presented before the ISP confirms a purchase. If a payment is pending, failed, or reversed, the ISP must not treat it as settled; service access may be restricted when a trial or paid subscription expires or is not active.

Payment requests and confirmations may be handled through Safaricom Daraja/M-Pesa or other payment providers. Those providers process transactions under their own terms. NamsNet records payment and reconciliation information to operate the platform but is not a bank, mobile-money issuer, or the ISP's payment settlement account. The ISP should verify the final settlement and transaction status with its payment provider.

Any cancellation, renewal, refund, or billing adjustment rights shown at checkout or required by law remain applicable. Contact NamsNet support promptly if a subscription payment is duplicated, unmatched, or not reflected correctly.

4. Acceptable use and router integrations

The ISP must use the platform lawfully and only for networks and customer accounts it is authorised to manage. It must configure MikroTik API access securely, use a restricted account where possible, protect credentials, and review router changes before applying them. NamsNet is not responsible for an ISP's misconfiguration, unsafe credential sharing, third-party network failure, or actions taken by ISP staff using their authorised access.

5. Data and privacy

The ISP determines why and how it collects subscriber information and is responsible for providing appropriate notices, lawful grounds, and choices to those subscribers. NamsNet processes subscriber records to provide the platform and related support. For ISP account, subscription, platform security, and our own service administration, NamsNet may separately determine the purposes of processing. See the Privacy Policy for details.

6. Availability, suspension, and termination

We may perform maintenance, change or retire features, or temporarily restrict access to protect security, respond to legal requirements, address non-payment, or investigate a material breach. Where reasonably practicable, we will give notice before a planned material interruption or restriction. The ISP should keep its own independent records and backups and export its data before workspace closure where export tools are available.

Either party may stop using the service subject to any paid subscription terms presented at purchase and applicable law. Ending platform access does not cancel obligations already accrued or change the ISP's separate agreements with its subscribers.

7. Disclaimers and legal rights

The platform is provided as a software service and depends on internet connectivity, ISP equipment, and third-party services. To the extent permitted by law, NamsNet excludes implied warranties that cannot reasonably be guaranteed for a software platform. Nothing in these terms excludes or limits a right, remedy, or liability that applicable law does not permit us to exclude or limit.

8. Changes, governing law, and disputes

We may revise these terms when the service or applicable law changes. We will post the revised terms and update the effective date. If a change materially affects an ISP's paid use, we will provide notice where reasonably practicable. Continued use after the effective date means acceptance only to the extent permitted by law; an ISP that does not agree may stop using the service, subject to its existing payment obligations and legal rights.

These terms are governed by the laws of Kenya, subject to mandatory legal protections and the jurisdiction of competent Kenyan courts.

9. Contact and support

For platform questions, use the support-ticket process in NamsNet or call/WhatsApp 0786683419.
